Official Rules – 2005 7 UP "Shoot for $1,000,000@ Big East" Sweepstakes Promotion
NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. Void outside the United States and where prohibited by law. All federal, state and local laws and regulations apply. Game starts on or about January 15, 2005 11:59 am CT and ends February 24, 2005. Sweepstakes entries must be received by 11:59 pm CT February 24, 2005. See below for more information. Promotion is governed by the laws of the State of Texas. Limit one sweepstakes entry per day per person/household. No individual may enter under more than one name, address or email address.

One Contestant will be selected in a random drawing from among all eligible Sweepstakes entries received on each of the following dates for a total of 4 Contestants:

Non-winning entries will remain eligible for the following weeks drawing. Subject to compliance with the terms of these official rules (including execution of certain affidavits and releases as described below), the 4 selected contestants will travel to New York, New York on March 10-13, 2005 (as specified below) for the Big East $1,000,000 preliminary shot competition ("Shot Contestants"). Shot Contestants shall be notified by mail and required to sign and return an affidavit of eligibility and a release of publicity/liability within 3 days of issuance or an alternate Shot Contestant may be selected. Odds of being selected as a Shot Contestant determined by the number of eligible Sweepstakes entries received. Limit one Shot Contestant per family, household or organization for the duration of the Promotion.
PRIZE:
If selected as a Shot Contestant you win a 3 night/4 day trip for two to New York, New York to participate in the "Shot Competition". Trip includes round trip coach air transportation for two from the major U.S. airport nearest the Shot Contestant’s home to New York, New York, three nights (standard, double occupancy) lodging, airport transfers, and two tickets to the 2005 Big East Championship Basketball Game. Guests of Shot Contestants must travel together with Shot Contestant on same itinerary, and shall be required (or, if a minor, his/her parent/legal guardian shall be required) to sign and return an affidavit and release of liability/publicity prior to issuance of travel documents. A minor will not be allowed to participate in any portion of prize travel without being accompanied by his/her parent/legal guardian (who must be either the Shot Contestant or the travel companion). Travel arrangements shall be through Sponsor’s (Dr Pepper/Seven Up, Inc.) agent, on a carrier of Sponsor’s choice. Certain restrictions/blackout dates may apply, and travel is subject to applicable provider’s terms and conditions. Shot Contestants are responsible for all other travel expenses not specifically listed herein as being awarded. Trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles.4 Winners/Each ARV $2,280.00
Entrants acknowledge that the prize and its value are trip, tickets and only the chance to compete as described herein. The value of the chance to compete and the odds of winning the competition are dependent on a multitude of factors and cannot be determined with any degree of certainty and no odds or value on such aspect of the Promotion shall be ascribed to such portion.
PRELIMINARY SHOT COMPETITION: On Friday, March 11, 2005, the 4 Shot Contestants may be joined by contestants from other 7 UP promotions, all to compete in the same pool of Shot Contestants for the chance to be the "$1,000,000 Shot Finalist" for 7 UP. Each Shot Contestant will participate in the Preliminary Shot Competition. Each Shot Contestant will have one "warm up" shot, then shoot up to 10 (ten) basketballs provided by Sponsor at a regulation basketball goal from the free throw line. Shot Contestants will have 35 seconds to complete all 10 shots. No additional shots can be taken after the 10 basketballs have been thrown even if time is remaining on the clock. Shots must pass directly from Shot Contestant’s hand(s) and through the basketball goal, without touching the ground or any object or surface other than the backboard or rim, and without their foot touching or going over the free throw line before, during or after the shot, in order in order to be considered a "Successful Shot" all as solely determined by Sponsor. All Shot Contestants will shoot up to 10 basketballs within the 35 seconds, and each shot that passes through the basketball net shall be calculated as one "point". In the event that there is a tie, the Shot Contestants that tied will continue to the next round of play and the Preliminary Competition will continue. The Shot Contestant with the most "points" out of 10 shots will advance to the next round as determined solely by Sponsor. This process will continue, advancing each Shot Contestant with the most "points" until there is only one Shot Contestant remaining. No transfer of Shots between Shot Contestants will be allowed. The Shot Contestant with the most "points" will be the final winner of this Preliminary Shot Competition and shall be deemed the 7 UP "Shot Finalist". The 7 UP Shot Finalist will advance to the Final Event Competition described below.
ALTERNATE SHOT CONTESTANT: After the Shot Finalist has been chosen, the Shot Contestant with the 2nd highest number of points in the final round of the Preliminary Competition will be selected as an alternate shot finalist ("Shot Alternate"). If there is a tie between two or more Shot Contestants for the position of Shot Alternate, then those Shot Contestants who have tied for 2nd place ("2nd Place Shot Contestants") will compete in another round of competition from the free throw line (with the same rules as the Preliminary Shot Competition round(s)) to determine the Shot Alternate. In the event that there is a tie, the 2nd Place Shot Contestants that tied will continue to the next round of play and the competition to determine the Shot Alternate will continue. The 2nd Place Shot Contestant with the most "points" out of 10 shots will be declared the Shot Alternate as determined solely by Sponsor. This process will continue, advancing each 2nd Place Shot Contestant with the most "points" until there is only one 2nd Place Shot Contestant remaining. The Shot Alternate will compete in the Final Event Competition described below only in the event that the Shot Finalist cannot or will not attend the Final Event Competition for any reason in Sponsor’s sole determination.
FINAL EVENT COMPETITION: On Saturday March 12, 2005, during half time of the Big East Championship Basketball Game, the 7 UP Shot Finalist (one) will be joined by a Lincoln Mercury Shot Finalist (one) and will each have the opportunity to throw up to 10 (ten) basketballs provided by Sponsor from the free throw line into the regulation basketball hoop located inside Madison Square Garden at the same time from opposite ends of the basketball court. No warm up or trial shots will be permitted by Shot Finalists. Both Shot Finalists will each have a total of 35 seconds to shoot up to 10 (ten) basketballs. No additional shots can be taken after the 10 basketballs have been thrown, even if time is remaining on the clock. Each basketball shot that passes through the basketball net will be considered a "Successful Shot". Each Shot must pass directly from Finalist’s hand, fully through the net, without touching the ground or any object, other than the backboard or rim, and without their foot touching or going over the free throw line before, during or after the shot, all as solely determined by Sponsor, in order to be considered a "Successful Shot". The Shot Finalist will be awarded $10,000.00 for each Successful Shot (for instance if all ten shots are Successful Shots, the Shot Finalist will win $100,000).
At the same time on opposite ends of the court, the 7 UP Shot Finalist will be competing against the Lincoln Mercury Shot Finalist. At the end of the 35 seconds or after the 10 basketballs are thrown, whichever comes first, the Shot Finalist (either 7 UP Finalist or Lincoln Mercury Finalist) with the most "Successful Shots" will be deemed the winner of the Final Event. Each Shot Finalist will be awarded the total dollar amounts equal to the number of Successful Shots. In the event of a tie, the Shot Finalist who makes the first "Successful Shot" will advance to the next round. In the event neither Shot Finalist makes a "Successful Shot" neither Shot Finalist will advance to the next round.
The winner of the Final Event Competition will immediately proceed to the half court line of the court in Madison Square Garden and attempt to shoot one single basketball into the regulation basketball net. No warm up or trial shots will be permitted. The shot must pass directly from the Final Event winner’s hands, through the basketball net, without touching the ground or any object or surface, other than the backboard or rim, and without their foot touching or going over the half court line until the basketball is released from the Shot Contestant’s hand(s), all as solely determined by Sponsor, in order to be considered a "Successful Shot". If the half court shot is a Successful Shot, the amount won in Round One of the Final Event shall be multiplied by ten (for instance if all 10 shots are Successful Shots in such round, and a successful half court shot is thrown, the Shot Finalist will win $1,000,000).
GENERAL COMPETITION/FINAL EVENT RULES: Shot Contestants must show photo I.D. prior to the Preliminary Competition. Shot Contestants must be present at an information meeting regarding the Preliminary Competition to be held prior to the Preliminary Shot Competition to be determined by the Sponsor. The time, date and location of the information meeting, Preliminary Competition and Final Event Competition will be included in the Affidavit/Release of Eligibility or other communication(s) from Sponsor (subject to change at Sponsor’s sole discretion). If for any reason any Shot Contestant, Shot Alternate or the Shot Finalist is not at the information meeting, Preliminary Competition or Final Event Competition location at the date(s) and time(s) specified, he/she will be disqualified in Sponsor’s sole determination. Contestants and Finalist must wear soft-soled tennis shoes only to participate, and must attempt all shots with no third party assistance of any kind. Collegiate Basketball Officials will be present as judges, whose decisions along with the decisions of Sponsors are final. Basketball will be an NCAA approved regulation basketball provided by Sponsor. Shot Contestants must shoot without the aid of any third party, equipment or machinery other than those provided by Sponsor. All of Sponsor’s decisions regarding positioning of Shot Contestant, Shot Alternate or Shot Finalist, timing of throws, and other details of Preliminary Shot Competition, 2nd Place Shot Competition and Final Event shall be in Sponsor’s or its representative’s final and sole discretion. Preliminary Competition may be video taped. The Shot Finalist must be available and participate in public relations events.
All prizes of $200,000 or more will be paid in the form of an annuity, $50,000 annually, without interest, until the entire prize amount has been paid. If there is no Successful Shot made by the Shot Finalist, the Shot Finalists will each receive a consolation prize of $10,000.
CONDITIONS OF PARTICIPATION: By participating in the Promotion you accept and agree to these rules and the decisions of Sponsor’s independent judges, which shall be final and legally binding. No transfer of prizes permitted. Prize recipients are responsible for all applicable federal, state and local taxes on all prizes. By entering this Promotion, you hereby release Sponsor and its licensed bottlers, Big East Conference, Lincoln Mercury, ESPN Productions, Inc., and each of their respective parents, affiliates, and subsidiary companies, advertising and promotions agencies, and all of their respective employees, officers, shareholders, directors and agents (collectively, "Released Parties") from (i) any and all liability, loss, harm, damage, cost or expense, including all reasonable counsel fees and court costs incurred, property damage, personal injury and/or death; (ii) anything related to the production, promotion, or execution of this Promotion (or your participation therein), including preemption, cancellation, or rescheduling of any game; (iii) that which may occur in connection with acceptance and/or use of the prize or while participating in or traveling to any Promotion-related activity. Acceptance of prize constitutes permission for Sponsor and its designees to use winner’s name and/or likeness for purposes of advertising and trade in any medium, without further compensation, unless prohibited by law. Entrants are disqualified at any time for failure to comply with the terms of these rules or the Sponsor’s instructions.
The Released Parties and each of their agencies and partners are not responsible for any computer, telephone, satellite, cable, network, electronic or Internet hardware or software malfunctions, failures, connections or availability, or garbled, corrupt or jumbled transmissions, service provider/Internet/website use/net accessibility, availability or traffic congestions, or any technical error, or unauthorized human intervention, or the incorrect or inaccurate capture of sweepstakes entry or other information, or the failure to capture any such information. The Promotion Parties and each of their agencies and partners are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Promotion and assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, technical error, theft or destruction or unauthorized access to the websites related to the Promotion. Sponsor reserves the right, at its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Promotion or any website related to the Promotion, to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, macro, programmed or like entry methods will void all such methods, and disqualify any participant using such methods. The Promotion Parties and each of their agencies and partners are not responsible for injury or damage to participants’ or to any other persons computer related to or resulting from participating in this Promotion or downloading materials from or use of any website related to the Promotion. If, for any reason, the Promotion is not capable of running as planned by reason of, but not limited to, infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor, in its sole opinion deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion.
ELIGIBILITY: Participants must be legal residents of the United States, excluding residents of Puerto Rico. Must be 18 years of age or older. Employees of Sponsor and its licensed bottlers, Big East Conference, ESPN Productions, Inc., Lincoln Mercury, and any of their respective parents, affiliates, subsidiaries, advertising or promotion agencies or other individuals engaged in the development, production or distribution of Promotion materials and persons who are immediate family (parents, children, siblings, stepparents, stepchildren, stepsiblings and spouse) or who reside in the same household as persons in the preceding categories are not eligible to enter or win. Entrants must also not have played professional, semi-professional or collegiate basketball at any time.
